("User" or "you") and BitAfrika ("we," "us," or "our"), governing your access to and use of
our platform, services, and features.
1. Agreement to Terms
By registering for an account or using the BitAfrika platform, you agree to be bound by
these Terms, our Privacy Policy, and any additional terms that may apply to specific
services. If you do not agree with these Terms, you must immediately stop using the

ii. Update your account details promptly if any information changes.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and any
actions taken under your account. BitAfrika is not liable for any loss resulting from
unauthorized account access.
4. Risk Disclosure
4.1 Cryptocurrency Risks
Cryptocurrency trading is high-risk and speculative. Prices can fluctuate rapidly, leading
to substantial losses. BitAfrika does not guarantee any return on investment and provides
no financial advice. You should fully understand the risks before engaging in any
cryptocurrency transactions.
4.2 No Insurance or Guarantee
Cryptocurrencies are not insured by any government or financial authority. If the
platform or a third party holding your cryptocurrency experiences failure, your funds may
not be recoverable.
5. Prohibited Activities
You agree not to engage in any of the following:
i. Illegal or unauthorized use of the platform, including money laundering, fraud, or
financing terrorism.
ii. Interference with or disruption of our systems, including hacking or any other
malicious activity.
iii. Misrepresentation of identity or impersonation of others on the platform.
BitAfrika reserves the right to investigate and take legal action for any prohibited
activities and to terminate or suspend accounts engaging in such behavior.
6. Compliance with Anti-Money Laundering (AML) and Know Your Customer (KYC)
Regulations
BitAfrika complies with global AML and KYC regulations. You may be required to submit
personal information and documentation to verify your identity. Failure to complete KYC
requirements may result in suspension or termination of your account.
7. Fees and Taxes
7.1 Transaction Fees
You agree to pay all applicable fees for transactions made on the BitAfrika platform. These
fees will be clearly disclosed at the time of the transaction.
7.2 Taxes
You are solely responsible for complying with any tax obligations related to your
cryptocurrency transactions. BitAfrika is not responsible for tax reporting or filing on
your behalf.
8. Third-Party Services and Affiliates
8.1 Use of Third-Party Services
BitAfrika may integrate with or rely on third-party service providers for certain services,
such as wallet management, exchanges, or payment processing. While BitAfrika makes
efforts to partner with reputable providers, we are not responsible for any loss or damage
caused by third-party actions or failures.
8.2 No Endorsement of Third Parties
Third-party links or services on the platform are provided for convenience only. BitAfrika
does not endorse or assume responsibility for the content or actions of third-party
websites or services.
9. Suspension and Termination
9.1 User-Initiated Termination
You may terminate your account at any time by following the account deletion process on
the platform. Upon termination, you must cease all use of BitAfrika services.
9.2 Platform-Initiated Suspension or Termination
BitAfrika reserves the right to suspend or terminate your account at its sole discretion,
with or without prior notice, under the following circumstances:
1. Violation of Terms and Illegal Activities:
If you violate any terms of this Agreement or engage in illegal activities, such as fraud,
money laundering, or unauthorized use of the platform, your account will be closed, and
you will be permanently banned from BitAfrika. In such cases, BitAfrika will report you
to relevant law enforcement authorities for investigation and prosecution in accordance
with applicable laws. Additionally, BitAfrika reserves the right to pursue civil claims
against you for any damages resulting from your activities.
2. Failure to Provide Required Information (KYC/AML Compliance):
As part of our KYC (Know Your Customer) and AML (Anti-Money Laundering)
obligations, users must provide accurate and up-to-date personal information. Failure to
do so, or refusal to comply with verification requests, will result in the suspension of your
account. During suspension, you will not be allowed to perform any actions on the
platform, including deposits, withdrawals, or transactions, even if cryptocurrency is sent
to the platform. No access to funds will be granted until verification is completed.
3. Suspicious or Fraudulent Activity:
If BitAfrika detects any suspicious or fraudulent activity on your account, such as
unauthorized access, hacking attempts, or misuse of the platform, we may immediately
suspend or terminate your account to protect the security of the platform and other users.
4. Compliance with Legal Requirements:
BitAfrika may be required to suspend or terminate accounts based on legal obligations,
requests from law enforcement, or regulatory demands in jurisdictions where we operate.
Notice of Termination or Suspension
While BitAfrika will make reasonable efforts to notify you in advance, immediate
suspension or termination may occur without prior notice in cases of severe violations or
legal requirements.
Appeal Process
If your account is suspended or terminated, you may contact BitAfrika’s support team at
[email protected] to inquire about the reasons for the action. In some cases, an
appeal or resolution process may be available, but BitAfrika reserves the right to make
final decisions regarding account status.
10. Limitation of Liability
To the fullest extent permitted by law, BitAfrika and its affiliates will not be liable for:
i. Any indirect, incidental, or consequential damages resulting from the use of or
inability to use the platform.
ii. Loss of funds due to unauthorized access, cyberattacks, technical failures, or other
unforeseeable events.
iii. Losses resulting from third-party services or links provided on the platform.
You acknowledge that cryptocurrency transactions carry inherent risks and accept full
responsibility for your use of the platform.
11. System Downtime and Maintenance
BitAfrika may schedule system maintenance or experience unforeseen technical issues
that may temporarily suspend services. You acknowledge that BitAfrika is not responsible
for any losses incurred due to system downtime.
12. Intellectual Property Rights
All intellectual property, including trademarks, logos, content, and software on the
BitAfrika platform, belongs to BitAfrika or its licensors. You may not copy, distribute, or
modify any part of the platform without written consent.
13. Modifications to Terms
BitAfrika reserves the right to modify these Terms at any time. Significant changes will be
communicated to users via email or platform notifications. Continued use of the platform
after changes are made constitutes acceptance of the revised Terms.
14. Dispute Resolution
Any dispute arising from these Terms or your use of the platform shall be resolved
through binding arbitration or mediation, as chosen by BitAfrika, unless local laws
provide otherwise. This provision does not apply where arbitration is not enforceable by
law. You and BitAfrika hereby expressly waive trial by jury and the right to participate in
a class action lawsuit or class-wide arbitration. The prevailing party in the proceeding is
entitled to reasonable costs and attorneys' fees.
15. Force Majeure
BitAfrika shall not be liable for any delay or failure to perform its obligations under these
Terms due to events beyond its reasonable control, including acts of nature, war, civil
unrest, government restrictions, or failure of telecommunications or the internet.
16. Governing Law
This Agreement will be construed in accordance with and governed by the laws of the
country where the customer resides without giving effect to conflict of law principles.
